GENERAL CONDITIONS OF CONTRACT FOR BOOKING TRAVEL SERVICES
jollyticket.com offers customers the opportunity to book Travel Services such as plane tickets, hotels, vehicle rentals and tour packages through the web site www.jollyticket.com. Customers may put together multiple Travel Services to suit their plans and desires without having to purchase a complete tour package, as permitted under current legislation. Customers making a booking must save and/or print out a copy of these General Conditions for future reference.Jollyticket is a registered trademark belonging to San Lio Trade S.r.l. Section I - Definitions and scope of application
Unless otherwise specified in the specific conditions applied by individual Suppliers of selected Travel Services, the following terms and expressions will have the meanings shown below:
“San Lio Trade”: San Lio Trade S.r.l., with registered offices in Catania at Corso Italia no.85, registered in the Registry of Companies of Catania and Administrative Register no. 404861, tax code and VAT no. 05532350872, certified e-mail firstname.lastname@example.org; administrative concession of the Region of Sicily n.167S.9TUR, web site www.jollyticket.com.
“Jollyticket”: a registered trademark owned by San Lio Trade identifying the offer and sale of Travel Services and Tour Packages to Tourists by third parties or by San Lio Trade through the web site www.jollyticket.com.
“Web Site” or “Site”: the Site at the address www.jollyticket.com through which Tourists may view the attractions and tour packages offered by San Lio Trade or by the Supplier and book them.
“General Conditions”: these General Conditions regulating the sale of Travel Services through the Site.
“Special Conditions”: the conditions applied by Suppliers with whom Customers have signed a separate agreement through or with the aid of tools offered on the Site.
“T.C.” or “Tourism Code”: the regulations contained in Annex I to Legislative Decree 79/2011.
“Service”: any service offered on the Site other than Third Party Services, consisting, generally speaking, in an opportunity to book transportation, accommodations, vehicle rental, attractions and insurance services.
“Travel Service”: an air transportation and/or accommodations and/or vehicle rental service which the Customer may purchase or put together independently through the Site. Travel Services are normally provided by third parties.
“Tour Package”: travel, holidays, “all-inclusive” tours and cruises produced by any person putting together at least two of the elements listed below, sold or offered for sale for a lump sum price: (a) transportation; (b) accommodations; (c) tourism services which are not accessory to transportation or accommodations identified in art. 36 T.C. constituting a significant part of the "Tour Package" for satisfaction of the Tourist's recreational requirements. Tour Packages are normally provided by third parties.
“Third Party Service”: A Travel Service and/or Tour Package offered to Customers on the Site directly by third party Suppliers stipulating contracts with consumers without the intermediation of San Lio Trade. In this case, San Lio Trade does not play an active role but simply offers the Site as an interface for these parties, who will supply their own Travel Services.
“Tourist” or “Customer”: the purchaser of a Third Party Service or an Attraction, or a person to be named (provided they meet all the necessary conditions for use of the Service, on behalf of whom the main party to the contract agrees to purchase one or more Travel Services or one or more Tour Packages without being paid to do so).
“Supplier”: any party other than San Lio Trade that makes the purchase of Travel Services and/or Tour Packages available through the Site or supplies them to the Tourist in any way.
“Attractions”: ticket offers for shows and tourist attractions.
“Trip Organiser” or “Organiser”: a party undertaking to procure Tour Packages for third parties in its own name, against payment of a fee.
“Intermediary”: a party who, even if not professionally and not to make a profit, sells Tour Packages against payment of a lump sum or separate individual tour services or agrees to procure them for third parties .
“Working days” and “working hours”: Monday through Friday, excluding national holidays, with working hours being from 9:00 to 18:00 Italian time.
“Call Center” or “Customer Assistance Service“: an office providing assistance to San Lio Trade Customers which may be reached at these contacts:+39.095.5867.111*
Service available Monday–Friday from 9.30 a.m. to 13.00 p.m and from 4.00 p.m to 6:30 p.m.
*cost of the call: for calls made from outside Italy, the cost will depend on the telephone service provider.
- San Lio Trade may also operate as an Intermediary or Organiser of services: in this case San Lio Trade shall explicitly notify the Customer of this fact and apply, together with these General Conditions, Special Conditions of which the Customer will be notified when making a purchase.
Art.2 Field of application
San Lio Trade offers its Customers the opportunity to book and purchase through its Web Site www.jollyticket.com a number of Travel Services including plane tickets, hotels, vehicle rental and travel insurance. Only Customers who have viewed and accepted these General Conditions as part of the process of completing their booking may use the Services offered by San Lio Trade and by Suppliers. If a Customer does not accept these General Conditions, he or she will not be able to complete the booking.
These General Conditions apply to display on the Site of Services (as defined above) by San Lio Trade, and to activities performed by San Lio Trade to make the Services available on the Site for booking by Customers. The purchase of Services constitutes a contract between the Customer and the Supplier of the Services.
These General Conditions are subject to the Supplier's Special Conditions, of which the Customer is notified and which the Customer accepts at the time of booking. The Customer agrees to view the Supplier's Special Conditions before making a purchase.
These General Conditions may be amended by San Lio Trade at any time without advance notice. These changes will not apply to bookings that have already been accepted by San Lio Trade on behalf of the Supplier concerned. The Customer must therefore read, save and/or print out a copy of the General Conditions when making each booking.
Section II - Booking through the Site
Art.3 Booking through the Site – Customer's obligations
Customers may search for Travel Services and Tour Packages offered by Suppliers through the Site, and make the necessary bookings; the Site acts as an interface in transactions conducted with Suppliers. The Site therefore displays Services and makes them available for booking by Customers. Contracts for the purchase and booking of Services shall be stipulated between the Customer and the Supplier of the Services.
The Customer must be aged 18 or over, be legally qualified to sign contracts and have the necessary authorisation or power to act for and in the name of each person included in a booking (where applicable).
The Customer guarantees the accuracy of the personal information supplied by him or her and, where applicable, the information supplied on people travelling with him or her. The Customer is responsible for activities conducted through the Site and for the consequences of possible use of his or her Site access Credentials.
Any fraudulent use of the Site or use in conflict with these General Conditions shall justify denial of access and of use of the Services offered by San Lio Trade and by the Suppliers and other Site functions.
Art.4 Confirmation of booking
Confirmation of each booking, including essential information on it, such as the description of the Service(s) or Package(s) booked and the price, shall be sent to the Customer by email. If the Customer does not receive email confirmation within 24 hours of making a booking, he or she must contact the San Lio Trade Customer Assistance Service by sending an email to email@example.com or calling the Customer Assistance Service at the number specified by San Lio Trade during working days and hours.
Data stored in the information systems of San Lio Trade and/or its Suppliers will constitute proof of the Customer's bookings, and shall have the same value as a printed document.
Art.5 Changes to bookings
Without altering the provisions of art. 37 (“Significant changes to conditions of contract and cancellation of Tour Packages”), if a Customer wishes to make changes to the date, destination, point of departure, accommodations or travel arrangements after making a booking, the Customer must send an email to firstname.lastname@example.org or call the Customer Assistance Service at the number specified by San Lio Trade during working days and hours. Except in cases of (i) prepaid hotel bookings; (ii) flight bookings or (iii) Third Party Services, San Lio Trade may charge a standard administrative fee for each of the changes made, notifying the Customer prior to making the changes. In order to change a Customer's booking, San Lio Trade will normally proceed by cancelling the original booking, which may entitle the Customer to receive a refund and/or require payment of an administrative fee imposed by the Supplier up to the entire value of the trip booked; the Customer will in this case be required to pay the price of the new booking.If you choose e low cost flight the company will require you to pay an additional sum for any changes or cancellations. Changes or cancellation are possible only on the low cost airline website.
Art.6 Cancellation of bookings
Without altering the provisions of art. 37 (“Significant changes to conditions of contract and cancellation of Tour Packages”), cancellations may be made by sending an email to email@example.com or calling the Customer Assistance Service at the number specified by San Lio Trade during working days and hours. All requests will be fulfilled on behalf of individual Suppliers, under the terms and conditions that they apply.
Total or partial cancellation of a booking by a Customer may result in charging of a fee to cover the costs already borne in organisation of the trip (where applicable) by San Lio Trade or the Supplier. In the case of cancellation of a booking involving more than one traveller, all cancellation fees will be charged to each traveller in the same booking. In some cases, cancellation fees charged by Suppliers may amount to the entire value of the trip booked; in this case no refund will be made to the Customer. Partial cancellation will not be possible without losing the payment made for the specific service in question.
San Lio Trade shall not apply processing fees to cancellation of flight bookings (where possible) unless otherwise specified; a specific fee may however be applied by the Supplier (in accordance with the Supplier's Special Conditions, of which the Customer was notified during the booking process). San Lio Trade reserves the right to calculate and charge processing fees for booking, changing and/or cancelling vehicle rental.
If the Customer does not appear at the place and time of departure no amount will be refunded (even if theoretically permitted). San Lio Trade reserves the right to cancel bookings in the event of failure to make prompt payment or if payment is not successfully concluded.
If you choose e low cost flight the company will require you to pay an additional sum for any changes or cancellations. Changes or cancellation are possible only on the low cost airline website.
Any refunds payable to Customers shall be credited, after subtraction of the necessary deductions, by the party that received the original payment to the payment card used to conduct the original transaction. Booking fees, if any, shall not normally be refunded, subject to the provisions of art. 37 (“Significant changes to conditions of contract and cancellation of Tour Packages”).
The Customer acknowledges that the amount of time required to credit a refund, and the amount thereof, normally depends on the individual Supplier.
Art.8 Reduced rates
Customers are assumed to be requesting the least expensive Services available, unless otherwise specified. These Services (referred to as “economy class” or “standard” services, or a similar term) shall be supplied without offering any opportunity to make changes or cancellations. In this case the Services cannot be supplied differently or at a different time or place from the agreed one.
Art.9 .Travel documents
The travel documents required for Services requested through the Site will be sent to the email address supplied by the Customer at the time of booking and/or made available by logging in to the Site. San Lio Trade or the Supplier may not be held liable if it is impossible to deliver travel documents due to a mistake made by the Customer when supplying his or her personal data or email address or by inability to access the Site.
Unless otherwise stated in the Special Conditions, the prices of Services are shown on the Site in Euro. The price of Services will be as stated on the Site in each case, except in the case of manifest material error. Prices may be updated at any time; changes will not apply to bookings already made, with the exceptions identified in the Supplier's Special Conditions.
The price of Services booked through the Site or by telephone must be paid to (i) San Lio Trade, which will accept payment on behalf of the Supplier, and/or (ii) directly to the Supplier. Payments may be charged by more than one party (as shown in the statement of account which the Customer will receive for the direct debit card or credit card used). In any case, the total cost charged will not exceed the total price of the Services.
Art.11 Material error
San Lio Trade agrees to do its best to prevent errors or incorrect information. If, however, an incorrect price should appear on the Site as a result of a material error, the Customer shall not be entitled to obtain the Service at this price if it is clearly wrong and this circumstance has been caused by a recognisable material error (for instance, if all-inclusive accommodations in a luxury resort are advertised at a cost of 1 Euro, and not as part of a promotion) or is the result of a technical error in the system or incorrect information provided by the Supplier, even if the Customer has received email confirmation of the booking.
San Lio Trade agrees to do everything in its power to ensure that the information contained in the Site on Services offered is accurate and up to date. However, the information contained in the Site is supplied by the Suppliers of various Services, and therefore, under the applicable legislation, San Lio Trade may not be held liable for its accuracy and precision.
Art.12 Photos and illustrations
Photos and illustrations appearing on the Site offer an approximate representation of the type of Service offered. The purpose of these photos and illustrations is to demonstrate the conditions and level of comfort of the accommodations to the Customer; they may not be considered as a guarantee beyond this purpose, unless expressly indicated in each photo or illustration.
The prices indicated on the Site do not include the cost of insurance. In some cases the Customer may stipulate an insurance policy covering the cost of cancellation under certain circumstances and an additional policy covering certain specific risks (such as the cost of returning home in the event of accident or illness). The Customer must read the conditions of the policy carefully before purchasing it.
The risks covered by the above-mentioned policies, and the cost and amount of coverage, are shown on the Site for illustrative purposes only. If the Customer stipulates a policy, the Insurer will send it or have it sent to the Customer. Claims must be presented directly to the insurer in accordance with the terms and conditions of the policy.
Customers may purchase or book Services through the Site by means of the procedures and methods specified therein. Customers must provide their identifying information and contact information (such as, for example, name, surname, official address of residency or domicile, email, etc.).
Customers shall pay for the Services purchased in full at the time of selection of the Service, using a credit or direct debit card. Before proceeding to purchase the selected Service, the Customer must make sure that his or her existing account or means of payment has sufficient funds available to pay for all the selected Services, including Third Party Services. If insufficient funds are available, though San Lio Trade will not charge any costs or fees to the Customer's account, making the purchase could cause the amounts to be frozen in the Customer's credit card account until the amount of the transaction is officially released by the issuing bank and by the international credit card associations.
Information on the Customer's credit card shall not become available to San Lio Trade, but shall be transmitted and processed by a third party with demonstrated experience and dependability through a protected connection directly on the web site or platform of the party processing the transaction. San Lio Trade reserves the right to ask the Customer to provide additional information at any time (such as his or her home telephone number) and/or ask the Customer to send a copy of documents demonstrating ownership of the credit card used in the transaction. If the Customer should fail to submit the additional information or further documentation requested, San Lio Trade shall reserve the right not to accept the purchase or booking, notifying the Customer at the email address specified by the Customer; this may not be considered defaulting on the contract.
After receiving confirmation of the availability of funds from the bank issuing the Customer's credit card, San Lio Trade will send the Customer e-mail confirmation in accordance with art. 4 (“Booking confirmation”). The e-mail confirmation will specify the details of the purchase and/or booking. If any of the information is incorrect, or the Customer does not receive email confirmation within 24 hours, the Customer must contact the Customer Assistance Service without delay by calling the number appearing in the email confirmation or by sending an email to firstname.lastname@example.org. Taxation and foreign currency exchange rates may change between the date of the booking and the date of travel. The payment card issuer may apply an additional fee for foreign currency exchange.
Art.15 Refusal of payment
If the issuing bank refuses payment, the purchase will be suspended without any charge to the Customer. If there are other problems, for instance if a transaction is not concluded successfully or there is a problem making the booking, an amount corresponding to the total or partial cost of the planned purchase may be temporarily frozen on the Customer's credit card as a result of the existing credit card payment system. In this case San Lio Trade will not make any charges to the Customer's account. If funds are frozen in the Customer's credit card account, the Customer should send an email to email@example.com or call the Customer Assistance Service at the number specified by San Lio Trade during working days and hours. The amount of time required to release the funds depends on the bank issuing the credit card and on interbank circuits.
Art.16 Payment to different parties
In some cases, explicitly identified in advance, the Customer may make payments to more than one party in relation to a booking, for instance, to San Lio Trade and to a Supplier or to another party identified on the customer's credit card statement or bank statement, depending on the Service booked. The total amount charged will not exceed the total price of the Services.
On the occasion of San Lio Trade promotions, the total amount requested via the Site may not correspond to the total price payable for the Service purchased or booked by the Customer; in such cases, San Lio Trade may make a contribution toward payment for the cost of purchasing or booking the requested Service on the Customer's behalf. In this case, the prices shown on the Site will reflect the total price minus San Lio Trade's contribution, and will show the amount payable by the Customer. In the event of a refund, when permitted, the Customer will not be entitled to refund of any amount above and beyond the amount paid.
Sezione III - Specific services
Art.18 Common provisions
San Lio Trade operates the Site, showing Services and making them available for Customers to book. Contracts for the purchase and booking of Services shall be stipulated between the Customer and the Supplier of the Services.
This Section provides some preliminary general information on the terms and conditions of use of Services supplied by Suppliers: this preliminary information must not however be considered exhaustive, and shall not replace the Special Conditions. In the event of conflict or incompatibility between the General Conditions and the Special Conditions, the Special Conditions shall prevail.
Unless otherwise required by law, this preliminary information shall not give rise to any obligations or liability on the part of San Lio Trade.
Art.19 Travel destinations
Some travel destinations may present greater risks than others. Before booking travel to international destinations, San Lio Trade asks Customers to obtain information on and take note of all warnings, announcements, recommendations or prohibitions of travel that may be issued by the Crisis Unit, available at the web site www.viaggiaresicuri.it. For further informations on other countries, visit the website of the Ministry of Foreign Affairs of the nation or the corresponding site of the embassy / consulate
In offering trips to specific international destinations, San Lio Trade does not guarantee that travel to these destinations is advisable or risk-free, and it may not be held liable for damage or loss resulting from travel to such destinations.
Sezione III.1 – Air travel services
Art.20 Air travel services
All air travel services are subject to the Supplier's Special Conditions (including conditions of travel, fees and restrictions). The Special Conditions may include restrictions/limits and/or fees for changes or cancellation.
Art.21 Administrative and/or medical rules
Prior to departure the Customer must have fulfilled all the requirements of the regulations applicable to identification documents, passports, visas, currency and medical rules pertinent to his or her trip, conforming to these requirements and paying the cost of doing so.
The name appearing on the passport or identification document (where applicable) must coincide with the name appearing on the ticket; the Customer will not be able to travel if this is not the case. If one of the travellers should change his or her name after booking a trip but prior to departure, for instance due to marriage, the traveller must notify the Customer Assistance Service by sending an email to firstname.lastname@example.org or calling the Customer Assistance Service at the number specified by San Lio Trade during working days and hours.
Italian citizens are advised to contact the competent offices and consult the web site www.viaggiaresicuri.it for more information on passport requirements. For further informations on other countries, visit the website of the Ministry of Foreign Affairs of the nation or the corresponding site of the embassy / consulate. For information on Visa requirements, Customers should contact the embassy of the country they intend to visit.
No-Italian citizens are advised to consult their own embassy or passport office for information and advice on the applicable requirements, visas and passport requirements for the countries they intend to visit (and for returning to Italy).
It may take time to obtain a visa; Customers are therefore advised to present their applications well in advance of travel. San Lio Trade shall not be held liable for the results of failure to obtain the documents required to travel. Customers must also make sure they are aware of any changes to the applicable visa requirements before beginning travel. Customers are responsible for ensuring that they meet all the requirements for travel. San Lio Trade shall not be held liable for prompt supply or receipt of the necessary visas and travel documents. All losses, within reason, that may be suffered by San Lio Trade as a result of Customers' failure to comply with these requirements may be charged to the Customer, unless they were caused by incorrect or misleading information provided by San Lio Trade itself.
All travellers wishing to enter or travel through the United States of America under the Visa Waiver Program (VWP) must request authorisation to travel using the Electronic System for Travel Authorisation (ESTA). Calculate sufficient time to present the ESTA authorisation request, at least 72 hours prior to travel. For further information please contact the competent authorities and consult the web site of the United States Department of Homeland Security https://esta.cbp.dhs.gov.
A number of countries are introducing new requirements for air carriers in relation to the providing of personal information on all travellers carried on their aircraft. The data is collected when the Customer checks in at the airport, or, in some cases, when the Customer makes the booking. Allow more time for checking in for your flight.
Art.22 Liability of airlines
Airlines' liability for death, injury and damage is normally limited by national legislation, international transport treaties and the airline's Special Conditions, including conditions of transport.
San Lio Trade merely provides an electronic service for assisting and supporting the formation, booking and purchase of plane tickets, and so no charges may be made against San Lio Trade in relation to the operation of the flight or for defaulting on the contractual obligations of the airline or other service provider. All flights purchased via the Site are purchased solely and exclusively from the airlines or suppliers of tourism services offering them for sale, who will be solely liable for the flight, for the conclusion of the contract and for any differences, flaws, damages or losses in relation to the flights and to the tickets issued for flights purchased by the Customer.
Art.23 Impossibility of passenger substitution
Tickets are documents issued in a specific name and cannot be transferred to another person; name changes are not permitted unless otherwise specified at the time of purchase. If the Customer's name is incorrect, the Customer must cancel the booking and purchase a new ticket. This will result in payment of a penalty specified by the airline, calculated on the basis of the Special Conditions, and, if requested of San Lio Trade, a processing fee indicated by it prior to conclusion of the transaction.
Sezione III.2 – Accommodations services
Art.24 Hotel bookings
Accommodations services are subject to the Special Conditions of the Suppliers who offer these Services. Their Special Conditions may include restrictions and/or cancellation/change fees applied by Suppliers.
The Customer may, depending on the circumstances, decide to pay online at the time of booking (charging the amount to his or her credit card immediately) or at a later time in the hotel (in which case the hotel will charge the amount to the credit card in local currency at the time of travel). Before making the booking, the Customer will be informed whether a deposit is required and the terms and conditions of refundability.
If a Customer does not appear by the agreed check-in time for the first night booked but does intend to check in for the subsequent nights booked, the Customer must confirm the change to the booking to San Lio Trade no later than the original check-in date to prevent cancellation of the entire booking.
Customers who do not change or cancel their booking within the cancellation deadline specified by the hotel, which varies depending on the hotel (normally between 24 and 72 hours prior to the arrival date), may be charged the amount specified in the applicable rules and restrictions at the time of booking the hotel. Some hotels do not permit changes or cancellation of bookings once they have been made, and these restrictions are indicated in the applicable rules and restrictions at the time of booking the hotel.
The Customer may not book more than 9 rooms online for the same hotel and the same dates of travel. If more than 9 rooms are booked in separate bookings, San Lio Trade reserves the right to cancel the bookings and charge the Customer a cancellation fee where specified. If the Customer has paid a non-refundable deposit, this deposit will be retained. Customers wishing to book 10 or more rooms must contact San Lio Trade by telephone or fill in the appropriate form online to be contacted by San Lio Trade.
Information on the level of comfort assigned to hotels in the description appearing on the Web Site corresponds to a description based on local standards in the country concerned. This classification is merely indicative. Standards may vary for hotels of the same class in different countries, and even within the same country. It is important to read descriptions of individual hotels carefully. Unless otherwise specified, accommodations in all hotels of all types should be considered standard.
Some activities offered by Suppliers and shown in the description of the accommodations on the Site may sometimes be cancelled, for instance due to adverse weather conditions, in the case of acts of force majeure, out of season, or if the required minimum number of participants is not reached. If the activity is included in a Tour Package, refer to the provisions of art. 37 (“Significant changes to conditions of contract and cancellation of Tour Packages”).
In the case of “tours”, the sequence of the various attractions visited is indicative only. The Supplier may change it.
In some countries local authorities may impose additional fees (such as tourist taxes), to be paid locally in the form and amount established. The Customer shall be solely responsible for paying such additional fees.
Sezione III.3 – Vehicle rental services
Art.28 Vehicle rental
Vehicle rental services are subject to the Special Conditions of each vehicle rental company acting as a Supplier.
Art.29 Method of payment
Unless otherwise specified on the Site, Customers making a booking must present a credit card when the vehicle is delivered. It is the Customer's responsibility to determine which credit cards the Supplier accepts.
During the vehicle rental period, the Supplier may ask the bank issuing the Customer's credit card to pre-authorise a given amount as a deposit. The Customer must contact the bank which issued the credit card to ensure that the credit ceiling on the card is sufficient to allow this.
If the Customer does not comply with these conditions, the Supplier will not supply the vehicle, and the Customer may still be charged the cost of vehicle rental.
Art.30 Extra charges
Extra charges such as refuelling charges, additional driver charges, young driver charges, delivery fees and payment collection fees may be charged locally. San Lio Trade and/or Suppliers may not be held liable for payment of such extra charges. A further charge may be applied if the vehicle is stolen or damaged. It will vary depending on the Supplier and the country of rental. It may be possible to reduce and/or eliminate this charge by purchasing optional insurance on the Site or locally (sometimes referred to as super CDW or super TP insurance). San Lio Trade and/or the Suppliers may not be held responsible for charging this amount or for supplying additional insurance.
Unless otherwise agreed, the Customer must return the vehicle to the Supplier's location where the vehicle was picked up. The Supplier may charge an additional fee if the Customer does not do so.
Sezione III.4 – Attractions and activities
Attractions are subject to the Special Conditions of the Suppliers who offer local activities, are normally not transferable and do not permit refunds or changes (unless cancelled by the Supplier and under the circumstances identified in art. 37 (“Significant changes to the conditions of contract and cancellation of Tour Packages”).
Services offered by Suppliers and shown on the Site may occasionally be cancelled, for instance due to adverse weather conditions, in the case of acts of force majeure, out of season, or if the required minimum number of participants is not reached. Customers are referred to the Special Conditions of the Supplier concerned for information on refunds in such circumstances and to art. 37 (“Significant changes to the conditions of contract and cancellation of Tour Packages").
Sezione V – Additional provisions
Art.33 Customer service and claim management
Enquiries, questions and complaints regarding Services provided by San Lio Trade may be sent by registered mail with return receipt via certified email to San Lio Trade@pec.impresecatania.it or by email to email@example.com or by calling the Customer Assistance Service at the number specified by San Lio Trade during working days and hours. To facilitate this procedure, Customers are asked to present claims within 30 days of the completion of travel.
Claims regarding Third Party Services and Tour Packages (such as, for example but not exhaustively, claims regarding loss, theft or damage to baggage and personal accessories, or late or faulty service) must be directed to the Supplier of the Service or Package.
Art.34 San Lio Trade's responsibility for Services supplied by San Lio Trade
In relation to the purchase of any Services that may be supplied directly and explicitly by San Lio Trade as Supplier, San Lio Trade acts as an intermediary and therefore San Lio Trade shall not be held liable for Suppliers' defaulting on their obligations in relation to Services supplied to Customers.
Art.35 San Lio Trade's responsibility for Services supplied by Third Parties and Tour Packages
In relation to the purchase of Third Party Services and Tour Packages, San Lio Trade does not perform any intermediation between Suppliers and the Customer and may in no case be considered the intermediary or organiser of these Services under the T.C. San Lio Trade operates the Site merely as a showcase for purchase in which Suppliers of Services may display their proposals. San Lio Trade cannot therefore be considered a party to a contract with the Customer for purchase of a Third Party Service.
San Lio Trade shall in no case be held responsible for the information supplied on the pages about Third Party Services or Tour Packages and may not be held liable for any damage that Customers may suffer in relation to Third Party Services or Tour Packages.
Art.36 Right of withdrawal
In accordance with the provisions of art. 55, paragraph 1, lett. b of Legislative Decree 206/2005 (the Consumer Code) and art. 32, paragraph 2, T.C., San Lio Trade explicitly states that Third Party Services and Tour Packages are not subject to the right of withdrawal described in articles 64, 65, 66 and 67 of Legislative Decree 206/2005. In fact, as stated in art. 55 of Legislative Decree 206/2005, “the right of withdrawal envisaged under art. 64 et seq., articles 52 and 53 and paragraph 1 of art. 54 shall not apply to: […] b) contracts for the supply of accommodations, transportation, dining and leisure services, if the professional agrees to supply the services on a given date or within a given range of dates at the time of conclusion of the contract”
Art.37 Significant changes to the conditions of contract and cancellation of Tour Packages
In the event that prior to departure there should be (i) a significant change to one or more elements of the Tour Package (art. 41 T.C.), such as a price increase of more than 10%, which is not accepted by the Customer, or (ii) the Tour Package is cancelled for any reason other than a cause attributable to the Customer (art. 42, T.C), the Customer shall be entitled to enjoy use of another Tour Package of equivalent or superior quality without paying an additional fee, or of a Tour Package of inferior quality with refund of the difference in price, while retaining the right to claim compensation for damages; alternatively, the Customer may obtain a refund of the amount paid for the Tour Package (art. 42 T.C.), reserving the right to claim compensation for damages.
The Customer must state whether or not he or she accepts the changes to the Tour Package within 2 working days of being notified of the change (art. 41, paragraph 3, T.C.).
The Customer shall be entitled to receive a refund of the amount paid under this article within 7 working days (art. 42, paragraph 1, T.C.).
If it becomes impossible to provide one or more services essential to the Tour Package after the date of departure, the Customer will be offered an alternative solution at no extra cost or will be refunded the difference between the value of the services originally offered and those actually provided, while reserving the right to claim compensation for damages (art. 41, paragraph 4, T.C.).
If it is impossible to provide alternative services or the Customer refuses them with just cause, the Customer will be provided with a means of transportation permitting return to the point of departure or another agreed location at no extra cost, along with a refund of the difference between the cost of the services offered and the services effectively provided, while reserving the right to claim compensation for damages (art. 41, paragraph 5, T.C.).
Unless otherwise stated in these General Conditions, all guarantees, terms and condition, whether explicit or implicit, in relation to this Site or to the information contained in it shall be excluded to the extent permitted by law.
Art.39 Applicable law and jurisdiction
Relations between San Lio Trade and the Customer are subject to Italian law.
If a contract is stipulated between a Professional Customer (that is, a physical person or corporate entity acting in the performance of his/her/its enterprise, commerce, trade or profession, or an intermediary thereof) and San Lio Trade in accordance with these General Conditions, the Court of Catania shall have exclusive jurisdiction over all issues pertaining to the the interpretation, validity and execution of the Contract.
Art.40 Final provisions
If San Lio Trade should fail to avail itself of the one of the provisions of the General Conditions at any time, this may not be interpreted as signifying renunciation of the right to apply this provision at a later time.
Should a court or other competent judicial authority find any provision or part of a provision of these General Conditions to be invalid, unlawful or inapplicable, it shall not be considered a part of this contract with the Customer, to the extent required, while the other provisions shall remain applicable.
In the event of force majeure, the obligations contained in these General Conditions which are specifically affected by the act of force majeure shall be suspended, and the party affected by the event of force majeure may not be held liable for the impossibility of fulfilling the obligation.
